Product Warranty

VERTIX Limited Warranty Agreement

1. Warranty Coverage

1.1. Warranty Duration:

  • For customers within the European Union (EU): 2 years from the date of purchase.
  • For international customers: 1 year from the date of purchase.

1.2. Covered Products: This warranty applies to all VERTIX products (hereinafter referred to as "Products") manufactured by VERTIX sold directly or through authorized distributors and resellers.

1.3. Scope of Warranty:

  • Radio Set: Warranty Duration as stated in 1.1
  • Accessories Subject to Wear and Tear (including batteries): Covered for 90 days from the date of purchase

2. Warranty Limitations and Exclusions

2.1. Exclusions: This warranty does not cover:

  • Normal wear and tear, including but not limited to scratches, abrasions, and changes in the appearance of the product.
  • Damage caused by accidents, misuse, abuse, neglect, improper handling, or unauthorized modifications or repairs.
  • Incidental or consequential damages, including but not limited to, loss of data, injury, death, or any loss incurred while using the Products.

2.2. Disclaimer: The Products are provided "as is" and "as available" without any warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability and fitness for a particular purpose. Users agree to use the Products at their own risk.

2.3. User Agreement: By purchasing and using VERTIX products, the user agrees to:

  • Assume all risks associated with the use of the Products.
  • Understand that the Products may operate improperly at times and acknowledge that this warranty does not cover any incidental losses, injury, or death due to such improper operation.
  • If these terms are not acceptable, the user should not purchase or use the Products.

3. Claim Process

3.1. Claim Submission: To make a warranty claim, please contact VERTIX customer service or the authorized distributor/reseller from whom the product was purchased. Provide proof of purchase and a detailed description of the issue.

3.2. Shipping Responsibility: For warranty claims, the user is responsible for shipping the product to VERTIX or the authorized distributor/reseller for evaluation. If the product is found to be defective and covered under this warranty, VERTIX will repair or replace the product at no charge. The user is responsible for the return shipping costs after the product has been repaired or replaced.

3.3. Evaluation and Repair/Replacement: VERTIX will evaluate the claim and, at its sole discretion, repair or replace the defective product. Any repaired or replaced product will be warranted for the remainder of the original warranty period or 90 days from the date of repair or replacement, whichever is longer. VERTIX shall not be held responsible for loss or theft during the delivery of the items to or from VERTIX.

4. Legal Jurisdiction

4.1. Governing Law: This warranty is governed by and construed in accordance with the laws of Singapore.

4.2. Jurisdiction: Any legal proceedings arising out of or relating to this warranty shall be convened in Singapore unless prohibited by law in the respective jurisdiction. In such cases, the legal proceedings will be conducted according to the laws applicable in that jurisdiction.

4.2. Limitation of Liability

TO THE FULL EXTENT ALLOWED BY LAW, XTREME DSP GLOBAL PTE LTD EXCLUDES FOR ITSELF, ITS SUPPLIERS, DISTRIBUTORS AND RESELLERS ANY LIABILITY, WHETHER BASED IN CONTRACT OR TORT (INCLUDING NEGLIGENCE), FOR INCIDENTAL, CONSEQUENTIAL, INDIRECT, SPECIAL, OR PUNITIVE DAMAGES OF ANY KIND, OR FOR LOSS OF REVENUE OR PROFITS, LOSS OF BUSINESS, LOSS OF INFORMATION OR DATA, OR OTHER FINANCIAL LOSS ARISING OUT OF OR IN CONNECTION WITH THE SALE, INSTALLATION, MAINTENANCE, USE, PERFORMANCE, FAILURE, OR INTERRUPTION OF ITS PRODUCTS, EVEN IF XDSP OR ITS AUTHORIZED RESELLER HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES, AND LIMITS ITS LIABILITY TO REPAIR, REPLACEMENT, OR REFUND OF THE PURCHASE PRICE PAID, AT XDSP’S OPTION. THIS DISCLAIMER OF LIABILITY FOR DAMAGES WILL NOT BE AFFECTED IF ANY REMEDY PROVIDED HEREIN SHALL FAIL OF ITS ESSENTIAL PURPOSE. IN ANY CASE, THE TOTAL COMPENSATION LIABILITIES OF XDSP OR ITS SALES AGENTS SHALL NOT EXCEED THE PRICE PAID FOR THE PRODUCT BY THE PURCHASER.

This warranty gives you specific legal rights, and you may also have other rights which vary from jurisdiction to jurisdiction.
